Padel Quarter – Padel Mates Participation, Liability, Health, Group Responsibility & CCTV Terms

1. Participation and Assumption of Risk

Participation in padel, fitness, coaching, competitions, social activities and any other activity taking place at Padel Quarter involves inherent risks, including but not limited to slips, trips, falls, collisions, contact with other participants or equipment, impact from balls or rackets, muscular injuries, strains, sprains and other physical injury.

By booking, attending or participating in any activity at Padel Quarter, you acknowledge these inherent risks and agree to take reasonable care of yourself and others.

You participate in activities at Padel Quarter voluntarily and are responsible for ensuring that you are physically and otherwise able to participate safely.

Nothing in these terms excludes or limits any liability that Padel Quarter cannot legally exclude or limit, including liability for death or personal injury caused by our negligence or any other liability that cannot lawfully be excluded or restricted.

2. Personal Responsibility

You are responsible for your own actions and behaviour while on the premises and during any activity.

You must follow all reasonable instructions, safety requirements, court rules and directions given by Padel Quarter employees, coaches, contractors or other authorised personnel.

You must not participate if you know, or reasonably believe, that you are not fit to do so safely.

If you become unwell, injured or unable to continue safely, you must stop participating and inform a member of the Padel Quarter team immediately.

3. Medical Conditions, Illness and Medication

Before participating in activities at Padel Quarter, you must inform a member of the Padel Quarter team of any medical condition, illness, injury, disability, allergy or other circumstance that may affect your ability to participate safely.

You should also inform a member of the team of any medication you are taking where that medication or its effects may reasonably affect your ability to participate safely or respond appropriately in an emergency.

You are responsible for ensuring that any information you provide is accurate and kept up to date.

Where Padel Quarter considers that participation may present an unacceptable risk to you or another person, we may require you to stop participating or seek appropriate medical advice before continuing.

Providing medical information does not mean that Padel Quarter accepts responsibility for monitoring or managing your medical condition or medication.

4. Personal Belongings

You are responsible for your own personal belongings while at Padel Quarter.

We recommend that valuable items are not brought onto the premises unless necessary and that all belongings are kept secure.

To the extent permitted by law, Padel Quarter is not responsible for loss of or damage to personal belongings where the loss or damage is not caused by Padel Quarter's negligence, breach of contract or other legal responsibility.

You should not leave valuables unattended in changing areas, courts, reception areas, vehicles or elsewhere on the premises.

5. Vehicles and Car Park

Vehicles are parked on or around the Padel Quarter premises at the owner's risk.

You are responsible for your vehicle and its contents and should ensure that it is properly secured.

To the extent permitted by law, Padel Quarter does not accept responsibility for theft of, or damage to, vehicles or their contents where Padel Quarter is not legally responsible for that loss or damage.

You must park responsibly, follow any applicable parking instructions and take reasonable care when entering, leaving or moving around the car park.

6. Damage to Padel Quarter Property

You are responsible for damage to Padel Quarter property, equipment or facilities caused by your deliberate, reckless or negligent actions, subject to applicable law.

This includes damage caused by you or members of a group for whom you have made a booking.

Normal wear and tear and accidental damage for which you are not legally responsible will not be treated as your responsibility.

7. Activities on the Premises

These terms apply to all activities undertaken on the Padel Quarter premises, whether booked directly through the Padel Mates app or otherwise, including but not limited to:

• Padel court use

• Coaching and lessons

• Social play

• Leagues and competitions

• Tournaments

• Fitness and exercise activities

• Events and parties

• Training sessions

• Use of ancillary facilities and equipment

• Any other recreational or sporting activity taking place on the premises

Participation in any such activity is subject to these terms, together with any specific rules or instructions applicable to that activity.

8. Group Bookings – Responsibility of the Main Booker

Where a booking is made for more than one person, the person making the booking ("the Main Booker") is responsible for the booking and for ensuring that every member of their group is aware of, and complies with, the relevant Padel Quarter terms, rules and safety requirements.

The Main Booker must ensure that each person in their group:

• Is aware of the nature of the activity they are participating in;

• Is fit and able to participate safely;

• Has disclosed any relevant medical condition, illness, injury, allergy or medication to a member of the Padel Quarter team where this may affect their ability to participate safely;

• Understands and follows the applicable safety rules and instructions; and

• Behaves appropriately and respectfully towards staff, coaches, other customers, equipment and the premises.

The Main Booker must provide accurate information about the members of their group where requested by Padel Quarter.

The Main Booker must not assume that a booking on behalf of another person means that Padel Quarter has received that person's medical or other relevant information.

Each individual participant remains responsible for their own health, safety, actions and participation.

Where a member of the group is under 18, the Main Booker or responsible adult must ensure that the appropriate parent/guardian consent and information has been provided where required by Padel Quarter.

9. Children and Young People

Parents, guardians and responsible adults remain responsible for children and young people in their care while on the premises, unless Padel Quarter has expressly accepted a specific supervisory responsibility as part of a booked service.

Parents, guardians and responsible adults must ensure that children and young people follow all relevant safety instructions and facility rules.

10. Padel Quarter's Responsibility

Padel Quarter will take reasonable steps to provide its facilities and services with reasonable care and skill and to maintain appropriate safety arrangements.

Nothing in these terms is intended to exclude or restrict any legal responsibility that Padel Quarter cannot lawfully exclude or restrict.

Where Padel Quarter is legally responsible for loss, damage or injury, our liability will be dealt with in accordance with applicable law.

11. Agreement to These Terms

By making a booking, attending Padel Quarter or participating in an activity, you confirm that you have had the opportunity to read and understand these terms and agree to comply with them.

Where a booking is made for a group, the Main Booker confirms that they will communicate these requirements to the members of their group and accept responsibility for ensuring that the information provided to Padel Quarter about the group is accurate.

These terms do not remove or reduce any rights you have under applicable consumer protection legislation.

12. CCTV, Video Surveillance and Data Protection

For the safety and security of our customers, employees, coaches, contractors and visitors, Padel Quarter operates CCTV and video surveillance systems throughout relevant areas of the premises.

CCTV may capture images of you while you are on the premises, including while entering or leaving the building, using the facilities, participating in activities, using communal areas and using the car park or other monitored external areas.

CCTV is used for legitimate purposes including:

• The safety and security of customers, employees and visitors;

• Prevention and detection of crime;

• Prevention and investigation of incidents, accidents, damage or misconduct;

• Protection of Padel Quarter property, equipment and facilities;

• Supporting the investigation of complaints, disputes or insurance matters; and

• Compliance with our legal, regulatory and insurance obligations.

CCTV footage is not intended to be used for purposes unrelated to these purposes unless permitted or required by law.

By entering the Padel Quarter premises, you acknowledge that CCTV and video surveillance may be in operation and that your image may be captured and recorded for the purposes described above. Appropriate CCTV signage is displayed around the premises to provide further information.

Padel Quarter processes CCTV footage in accordance with applicable UK data protection legislation, including the UK GDPR and Data Protection Act 2018.

Where appropriate, CCTV footage may be disclosed to the police, emergency services, insurers, legal advisers, regulators or other authorised third parties where this is necessary, lawful and proportionate.

CCTV footage will only be retained for as long as reasonably necessary for the purposes for which it was collected, subject to any longer period that may be necessary where footage is required for the investigation of an incident, insurance matter, legal claim, crime or other legitimate purpose.

Access to CCTV footage is restricted to authorised persons and is subject to appropriate security measures.

CCTV is not operated in areas where individuals would ordinarily have a reasonable expectation of privacy, such as toilets or changing rooms.
